Terms of Service

Website Design Albury terms for websites, SEO, Google Ads and maintenance

These Website Design Albury terms explain how quotes, payments and ongoing plans work. They are written in plain English so you know where you stand before any work begins.

About These Terms

Who they apply to

Website Design Albury is run by Nick Fritzkowski as a sole trader. When I say I, me or my, I mean Nick and the business. When I say you, I mean the person or business engaging me.

These terms apply to website builds, SEO plans, Google Ads management, WordPress maintenance and any other work I do for you. Accepting a quote or paying a deposit means you agree to them. If a written quote says something different, the quote takes priority for that job.

Quotes, Deposits and Payment

Clear pricing before work starts

Every quote is in writing, includes GST and is valid for 30 days. It lists what is included so there are no surprises later.

Website builds need a deposit before work starts. The balance is due before the site goes live. Monthly plans are billed in advance each month.

Work outside the original quote, such as extra pages or new features, is quoted separately and only goes ahead once you approve it.

Your Content

What I need from you

You are responsible for supplying content such as text, photos, logos and business details. You also need to make sure you have the right to use them. I can help write and polish content, but you need to check it is accurate before launch.

Delays in receiving content or feedback can push out the timeline. If a project stalls for a long period, I may ask for part of the balance to cover work already completed.

Ownership of Your Website

Once it is paid for, it is yours

Once your website is paid in full, you own it. You get full administrator access to WordPress and Elementor so you can edit it yourself or move it to another provider if you choose.

Themes, plugins and stock images used on the site remain under their own licences. Some premium plugins need an active licence to keep receiving updates.

I may mention that I built your site, for example with a small credit in the footer, unless you ask me not to.

Third Party Costs

Things paid for separately

Some costs sit outside my fees and are paid by you, either directly or passed on at cost.

Monthly Plans and Cancelling

SEO, maintenance and Google Ads

SEO plans and WordPress maintenance plans run month to month with no lock in contract. To cancel, give me 30 days notice in writing and the plan ends after that period.

Google Ads management has minimum terms. The Basic plan has a 6 month minimum and the Essentials and Business plans each have a 3 month minimum. Any setup or takeover fee listed on the Google Ads page is charged once at the start. After the minimum term, 30 days notice applies.

SEO and advertising results depend on many things outside my control, including Google itself, so I cannot promise particular rankings or a set number of enquiries. I can promise honest work and clear reports.

Liability

Reasonable care on both sides

I take reasonable care with every job. To the extent the law allows, I am not responsible for indirect losses such as lost profits. I am also not responsible for problems caused by third party services like hosting companies, plugin developers or Google.

Nothing in these terms takes away rights you have under the Australian Consumer Law. If something goes wrong, tell me and I will do my best to fix it quickly.

Governing Law

New South Wales

These terms are governed by the laws of New South Wales. I may update them from time to time and the current version is always on this page. Questions are welcome, so call 0413 651 740 or email [email protected].
